On August 8, Searcy County Deputy Joey Baysinger was dispatched to High Street in Leslie concerning a person who was burning the ditches along the roadway that was not part of his property. According to Searcy County Sheriff Kenny Cassell, when Baysinger arrived on scene he found grass had burned from 650 High Street to 920 High Street.

Cassell arrived on scene and spoke to a person who told him they saw 61 year old Russell Galbreath of Leslie setting fire to the grass in the ditches. Cassell said he spoke to Galbreath who stated he did not set any fires and he "had been at his house drinking beer."

A few minutes later while driving down High Street, Cassell encountered Galbreath beside the road setting the grass on fire with a beer in his hand.

Galbreath was arrested and transported to the Searcy County Detention Center where he was charged with two misdemeanor counts - unlawful burning and public intoxication, drinking in public.
